GENERAL CONDITIONS OF SALE – Fête Impériale
These terms and conditions (the "General Terms") apply between the company Fête Impériale and any consumer ('you') making an order on the www.feteimperiale.fr site ('the 'site'). Sales on the site are aimed exclusively at consumers purchasing the items for personal use, excluding any resale.
The terms and conditions may be changed at any time. The applicable version of the terms and conditions is the one available on the site at the time of your order.

By checking the box "I accept the terms and conditions of sale" before confirming your order, you acknowledge that you have been fully aware of the terms and conditions and you accept them wholeheartedly.
ARTICLE 3. YOUR ORDER
To place an order, you must be a person of full age or an informed minor person.
To place your order on the site, you must select the chosen item, size and quantity, and then click the "add to the basket" button.
You must have a customer account, which you can create at any time, online, on the site.
To make any order, you must first read and accept the terms and conditions by checking the box "I accept the terms and conditions of sale." You then click the "I order" button.
In accordance with Article L122-1 of the Consumer Code, from Fête Impériale may refuse to execute an order for any legitimate reason, including if there is a dispute over the payment of a previous order.
Once the order has been validated and paid for, a confirmation of payment acceptance of the order and an acknowledgment worth confirming the order will be sent to you electronically. The order is then considered to have been placed.

The prices listed on the website are in euros and include all taxes included and excluding delivery costs.

The amounts of the delivery fee for the items are contained in Article 7. The details of the total amount you will be asked for will be listed on the "confirmation" page summarizing your order.

5.2 Securing payment
Payment is made via the secure online payment system of the BNP Bank. We do not store the bank details that you have communicated to us solely for the purpose of satisfying our legal obligations. The information related to your order is the subject of an automated data processing by our Bank, BNP Paribas, via its payment platform. The purpose of this automated data processing is to define a level of analysis of a transaction and to combat credit card fraud.
5.3. Invoice
Any invoice will be available, downloadable and printable in the "my account/orders" section as soon as your order is shipped. If the order is shipped in several times, you will have as many invoices as shipments at your disposal.
ARTICLE 6. AVAILABILITY OF PRODUCTS
Items are offered for sale within the limit of available stocks. You will be informed, before any order, of the availability of the desired item.

Delivery fees will appear on the site on the "delivery mode" page being ordered, and on the "confirmation" page summarizing your order.

ARTICLE 8. LEGAL GUARANTEES
You benefit from legal guarantees and in particular the guarantee of compliance under the conditions provided for in articles L211-4 to L211-14 of the consumer code and the guarantee of defects of the thing sold under the conditions provided for in articles 1641 to 1648 of the civil code.
In accordance with the Articles L121-21 and following of the Consumer Code, you have a retraction period of fourteen (14) days from the date of delivery of the items ordered. If you exercise such a right of withdrawal, you will be fully reimbursed for the sums paid for the items returned and accepted by the customer service. The return costs are your responsibility.

The refund will be made within seven (7) calendar days from Fête Impériale returned item date and returns thus made.
During the festive season, the return period is extended until 05/01/2021. The costs of returns remain the responsibility of the customer and must be made to the same address.
ARTICLE 10. INTELLECTUAL PROPERTY
The site is owned by from Fête Impériale, holder of the associated intellectual property rights.
The site and the constituent data of the site and its content, whatever their nature (text, photography, images, sounds, graphic elements, etc.) are likely to be protected under intellectual property.
It is recalled that all the distinctive signs, including the trademarks and logos, is and remains the property of from Fête Impériale or that of the intellectual property rights holders concerned. ARTICLE 12. RESPONSIBILITY
Given the technical constraints of the Site's use, the responsibility for from Fête Impériale cannot be initiated in the event of damage caused by a malfunction, which is not attributable to it, one or more of the steps of access to the site, the process of ordering, payment, follow-up of delivery, due in particular to the inconveniences inherent in Internet use, such as service disruption, external intrusion, presence of computer viruses.
On the other hand, the responsibility from Fête Impériale cannot be initiated in the event that the breach or misperformance of its obligations is attributable either to your own conduct, to the unpredictable and insurmountable fact of a third party to the contract, or to a case of force majeure.
ARTICLE 13. INTEGRITY AND VALIDITY OF THE GENERAL CONDITIONS
The terms and conditions and confirmation of your order form a contractual package that constitutes the entirety of the agreements between the parties.
If one or any of the terms and conditions were to be declared null and void in whole, the other provisions would nevertheless remain applicable in their entirety. If necessary, the cancelled provision would be renegotiated in good faith.
ARTICLE 14. APPLICABLE LAW AND DISPUTE SETTLEMENT
The terms and conditions are subject to French law.
In the event of a dispute regarding the interpretation or performance of the terms and conditions, the French courts will have sole jurisdiction.
